DIRECTOR, INTELLECTUAL PROPERTY
The Director, Intellectual Property will be responsible for managing Bare Escentuals’ Intellectual Property portfolio (i.e. trademarks, copyrights, patents and domain names) globally to insure protection and maintenance of the company’s brands. This position will focus on all phases of trademark clearance, prosecution, maintenance and enforcement as well as supporting business teams with respect to marketing, advertising and competitive review.

Primary Responsibilities
* Manage and oversee global trademark portfolio, including clearance, searching, negotiating resolutions of registry conflicts, working on a daily basis with internal clients on trademark selection and strategy, managing outside counsel and having responsibility for developing and maintaining budget related to IP filing and outside counsel fees.
* Work closely with Bare Escentuals business units to provide legal counsel and training on advertising and promotional law and consumer privacy issues arising from marketing or other business initiatives, including reviewing packaging artwork, print and media advertisements, and infomercials for proper trademark and copyright usage and compliance with advertising laws.
* Handle enforcement matters, such as coordination of investigations, drafting cease and desist letters and other pre-litigation enforcement measures.
* Manage IP litigation both in the U.S. and abroad, including working closely with outside counsel on developing and implementing litigation and enforcement strategies.
* Design and implement IP protection strategies and policies for Bare Escentuals.
* Review, draft and negotiate a variety of marketing, licensing, settlement, coexistence and consent agreements to ensure the effective acquisition and licensing of intellectual property rights.
* Supervise trademark paralegal including helping in prioritizing, managing workload and coaching performance.

Job Qualifications
* Juris Doctor or LLM from an accredited law school.
* Licensed to practice law in the U.S.
* Minimum 8+ years experience with law firm or corporate legal department, within in-house experience required.
* Extensive domestic and international intellectual property experience, including trademark prosecution and clearance, intellectual property related contract drafting and negotiation, and intellectual property litigation.
* Retail or consumer products experience strongly preferred.
* Licensing experience a plus.
* Advertising, privacy and promotions experience a plus.
